Daybreak Labs Refund Policy

IMPORTANT NOTICE. This Refund Policy is part of the Daybreak Labs Terms of Use. It is incorporated by reference into the Master Agreement (see Master §9 and Master §20) and applies to every Daybreak Labs Product, supplemented by any Product-specific refund terms in the applicable Product Schedule. Where this Refund Policy and a Schedule address the same point, the Schedule controls solely with respect to the Product it names; otherwise this Policy controls.
This Refund Policy describes how Daybreak Labs LLC ("Daybreak
Labs," "we," "us," or "our") handles refund requests for its
Products. Capitalized terms used but not defined here have the meanings
given in the Master Agreement at
daybreaklabs.studio/terms.
1. Refund Window
For one-time digital-download Products (including the Multi-Property Tax Strategy Workbook), you may request a refund within fourteen (14) calendar days of the date of your purchase. This window applies even if you have already downloaded the file. Refund eligibility within the window is governed by Sections 2 and 3 below.
Where a platform's own buyer-protection policy is more generous, it controls. Some Products may be sold through a third-party platform that acts as the merchant of record for your transaction (for example, a digital-storefront or payment platform). Where that platform applies its own refund or buyer-protection window that is more generous to you than this Policy, that platform's window controls for that transaction to the extent it is more favorable to you. This Policy continues to govern in all other respects and for Products sold directly by Daybreak Labs.
For subscription Products, refund mechanics are set out in the applicable Product Schedule. See Section 8.
This Refund Policy uses the term "purchase" to
describe your transaction with Daybreak Labs. Your purchase grants you a
limited, non-transferable license to access and use the Product as
described in the Master Agreement and the applicable Schedule. It does
not transfer ownership of the underlying intellectual property or grant
rights to redistribute the Product. A clear-and-conspicuous statement of
license terms is presented to you at the time of checkout, and the full
Terms of Use are available at
daybreaklabs.studio/terms.
2. Eligibility: When a Refund Will Be Approved
Refund requests submitted within the fourteen-day window will be reviewed in good faith. We will approve a refund where one or more of the following circumstances applies:
- Materially out-of-scope purchase. The Product is materially out-of-scope for your situation, and you can demonstrate this with a short explanation. For the Multi-Property Tax Strategy Workbook, the most common example is that you file Form 1040-NR or are otherwise a non-US tax filer for whom the Workbook's federal-only US tax model is not useful. We make this path frictionless: a short email is sufficient.
- Non-delivery or corrupted file. Your download link failed, the file did not reach you, or the file you received is corrupted and cannot be opened. In this case, you may choose either a replacement copy or a full refund.
- Duplicate or accidental purchase. You purchased the same SKU twice within a short period, or made an accidental purchase that you flag promptly. Duplicate purchases are refunded automatically on request.
- Unresolved technical defect. Daybreak Labs has been unable, after a reasonable support effort, to resolve a technical defect that materially prevents you from using the Product as described.
Refund requests submitted under one of these eligibility paths will be approved without further proof requirements beyond the buyer's account email and order ID. We respond to refund requests within two (2) business days of receipt; see Section 4.
3. Ineligible Situations
The following circumstances are outside the refund window or do not qualify within it:
- Post-implementation use. You have already implemented a planning strategy explained in the Product on a return that has been filed (in the case of the Multi-Property Tax Strategy Workbook) or otherwise materially relied on the Product to make a financial, legal, medical, or operational decision that has been acted on. The Product's value, once acted upon, has been delivered.
- Buyer's remorse after extensive use. You changed your mind after using the Product extensively (for example, after working through multiple property scenarios, generating multiple plan outputs, or downloading multiple companion materials). At that point the Product has been delivered as intended.
- Disagreement with the Product's general approach. Your CPA, advisor, or another professional disagrees with the strategy explained in the Product. Professional judgment varies; the Product is a planning tool, not a directive. Disagreement is not a defect.
- Buyer-side computational error. You entered incorrect values, misclassified a property or asset, or otherwise produced an output that does not match your actual facts. The Product's deterministic formulas are visible and inspectable in the file itself; user-entered values are the user's responsibility.
- Requests submitted after the fourteen-day window has expired, except in the case of an unresolved technical defect that you raised with support inside the window and that remains open.
- Renewal purchases more than fourteen days old. Renewal opt-in is at your discretion; non-renewal terminates access to future release files but does not affect any prior release file already in your possession (see Section 9).
The Workbook is sold as a one-time digital download. By initiating the download, you acknowledge that the Product has been delivered. Refunds are available only on the terms set out in this Policy and the applicable Schedule.
4. How to Request a Refund
Email support@daybreaklabs.studio from
the email address you used to purchase. Include:
- Your order ID (from the email receipt), or, if you cannot find it, your purchase date and the last four digits of the payment card.
- A short description of the reason for the request, mapped to one of the eligibility paths in Section 2 if applicable.
- The product name and tier (for example, "Multi-Property Tax Strategy Workbook, Multi-Property tier").
We respond to refund requests within two (2) business days of receipt. If we need additional information, we will say so and reset the response clock. If we approve the refund, we will confirm by email and initiate the refund the same business day.
5. Refund Mechanics
Approved refunds are issued in the full purchase price to the original payment method through Lemon Squeezy, our merchant of record (which processes card payments via Stripe). Refunds are not issued as store credit unless you specifically request that alternative and we agree in writing.
Processing time depends on Lemon Squeezy, its underlying payment processor, and the buyer's card-issuing bank. Refunds typically process within five (5) to ten (10) business days; in our experience the refund appears on the buyer's statement within that range. Daybreak Labs has no further control over the timing once the refund has been initiated.
If a refund is issued, your license to the Product terminates. Access to download links, update entitlements, and any associated materials may be revoked. See Section 7 on access revocation generally.
6. No Calculation, Outcome, or Accuracy Guarantee
Daybreak Labs does not offer a calculation-accuracy guarantee, a maximum-refund guarantee, an outcome guarantee, or any guarantee of any specific dollar amount of tax savings, refund, deduction, credit, or other financial result.
This is by design, not by omission. The Multi-Property Tax Strategy Workbook is educational content explaining tax strategies and the factors that influence them. It is not tax-return-preparation software, it does not compute or file your return, and it is not a substitute for the judgment of a licensed CPA, Enrolled Agent, or tax attorney. The same scope limitation applies to every other Daybreak Labs Product within its respective domain (see the applicable Schedule §S.4 and §S.10).
Daybreak Labs is not a tax-return preparer, is not subject to IRC §7216 or IRS Publication 4557, and makes no representations to the contrary in any Product, marketing surface, or communication. Decisions to implement any strategy explained in a Product should be reviewed with your own licensed professional. The remedies set out in Sections 1 through 5 of this Refund Policy are your sole and exclusive remedy for any dissatisfaction with a Product's content, scope, or output, and may not be combined with any other guarantee, warranty, or remedy claim against Daybreak Labs.
7. Chargebacks and Card Disputes
You retain the legal right to dispute a charge with your card-issuing bank. Daybreak Labs respects that right and does not, and will not, threaten consequences against you for exercising it.
Many issues can be resolved faster by email than through a card dispute, so we invite (but do not require) you to try the email path first:
- You are welcome to contact
support@daybreaklabs.studiobefore filing a card dispute. We respond within two (2) business days (Section 4) and resolve eligible requests without argument. Contacting us first is optional and is not a condition of any refund. - If a chargeback is filed, Daybreak Labs may respond to the card network on the merits. We retain delivery-evidence records (download confirmation, IP, timestamp, email receipt) for at least one hundred eighty (180) days from each transaction, and may submit that evidence to the card network where a dispute is filed. This is a routine evidentiary response and is not a penalty for disputing.
- A completed refund or chargeback ends the license, with the same neutral results either way. Because access to a Product is licensed rather than sold, when a transaction is refunded or reversed, the license granted by that transaction ends as a matter of contract, exactly as it would end on any refund. After the license ends, Daybreak Labs may discontinue the access that the license provided (download links, update entitlements, and hosted features), any renewal entitlement tied to that transaction lapses, and the license to use the Product (including under any copy shared with your CPA, Enrolled Agent, or tax attorney pursuant to Schedule §S.7) likewise ends. These are the ordinary contractual results of the license ending; they are not consequences imposed for exercising your dispute right, and they apply equally whether the license ends by refund or by chargeback.
Nothing in this Section 7 limits any non-waivable consumer-protection right you may have under applicable law, including statutory rights to refund for non-delivery (see Section 10).
8. Subscription Refunds: Reserved for Product Schedules
This Refund Policy v1.0 governs one-time digital-download Products. Refund mechanics for subscription Products will be set out in the applicable Product Schedule.
Until a subscription-Product Schedule has been finalized:
- You may cancel a subscription at any time. Cancellation stops future billing.
- The then-current billing period continues to its end; no pro-rated refund is owed for unused time within a billing period that has already been charged.
- If Daybreak Labs terminates the subscription for a reason other than your material breach of the Agreement, you are entitled to a pro-rated refund of any prepaid fees covering the post-termination period.
These defaults are placeholders. Any future subscription Schedule will fill in product-specific subscription refund mechanics, including any free-trial behavior and any commitment-period treatment.
9. Update Entitlement and Renewals
Some Daybreak Labs Products include an update entitlement. For the Multi-Property Tax Strategy Workbook, each SKU (Single-Property, Multi-Property, Pro Version) is a license key valid for one year from purchase, one activation, with an optional annual renewal at the then-current price. See Schedule §S.7 for the canonical statement.
If you cancel or do not renew an update entitlement:
- The original purchase is not refunded beyond the fourteen-day window in Section 1.
- Future renewal opt-in is at your discretion. Non-renewal terminates access to future release files but does not affect any prior release file already in your possession or any forwarded copy held by your CPA, Enrolled Agent, or tax attorney under Schedule §S.7.
- Renewal purchases more than fourteen days old are not refundable except as required by applicable law.
If a renewal charge appears on your statement that you did not
authorize, contact support@daybreaklabs.studio immediately.
Daybreak Labs does not enroll buyers in auto-renewal without affirmative
opt-in.
10. State-Specific Disclosures
The following disclosures are provided where applicable state consumer-protection law requires them. Nothing in this Refund Policy limits any non-waivable right you may have under your state's consumer-protection statutes.
- California. Pursuant to Cal. Bus. & Prof. Code
§17500.6 (AB 2426), your transaction with Daybreak Labs grants you a
license to access and use the Product. A
clear-and-conspicuous statement to this effect is presented at checkout,
with a link to the full Terms of Use. License restrictions are set out
in Master §9 and in the applicable Schedule §S.7. To the extent Cal.
Civ. Code §1723 applies, this Refund Policy is conspicuously posted at
daybreaklabs.studio/refundand is linked from the checkout page and the global site footer. - New York. Pursuant to N.Y. Gen. Bus. Law §218-a (as amended effective August 7, 2025), this Refund Policy is accessible by hyperlink near the Product listing and is displayed to the consumer prior to requesting billing information at checkout.
- New Jersey. This Refund Policy is not intended to, and shall not be construed to, waive any clearly established legal right of a consumer or responsibility of a seller under New Jersey or federal law, including under the Truth-in-Consumer Contract, Warranty and Notice Act (N.J.S.A. 56:12-14 to 56:12-18). Any provision of this Policy that would otherwise be unenforceable under New Jersey law is severable; the remainder of the Policy remains in effect.
- Oregon. Pursuant to Or. Rev. Stat. §646.607(2), where Daybreak Labs fails to deliver a Product you have purchased, you are entitled to a refund on request. Section 2 of this Policy makes that path explicit, and no limitation in this Policy applies to a non-delivery claim.
- Hawaii. Pursuant to Haw. Rev. Stat. §481B-5.5, this Refund Policy is conspicuously displayed at checkout in a manner reasonably calculated to bring it to the attention of purchasers before a purchase is made.
11. Changes to This Refund Policy
Daybreak Labs may modify this Refund Policy at any time by posting
the updated version at daybreaklabs.studio/refund and
updating the "Last updated" date. Modifications follow the protocol set
out in Master §22:
- Non-material changes (typographical corrections, clarifications, references, formatting) take effect upon posting.
- Material changes (including any change that materially reduces the refund window, narrows eligibility, or modifies Section 7 (Chargebacks and Card Disputes)) will, in addition to posting, be communicated by email (where Daybreak Labs has an email on file for you) and by in-Product notice. Material changes take effect on the date specified in the notice. Purchases completed before the effective date of a material change are governed by the Refund Policy in force on the date of purchase.
Every change to this Refund Policy is recorded in its version history, and the version number and last-updated date above change with it.
